Listing Placement and Advertising Terms & Conditions

These terms are applicable to all listings and advertisements accepted for inclusion on the Mad About Birkenhead web site and should be read alongside the general Terms & Conditions found above . References below to "we/our/us" are to Mad About Birkenhead. By submitting a listing or advertisement to us, you shall be deemed to have accepted these Terms & Conditions.

Placing a listing or advertisement
By sending your listing or advertisement to us, you are requesting that the listing or advertisement appears on our web site. We will contact you by e-mail to accept your listing or advertisement or to inform you if we are not able to accept the listing or advertisement for any reason. No contract is made between us until we have verified and accepted your listing or advertisement copy or content.

To ensure your listing or advertisement is placed on our site in the right format, you must provide all listing or advertisement copy by completing the standard order forms as found on the site.

To keep our listings up to date, we may from time to time request you to login and confirm your listing or advertisement details are correct and relevant. In the event you do not login and confirm the details of your listing or advertisement when requested to do so, we reserve the right to either temporarily or permanently remove it from the site. If your listing or advertisement was paid for by you then no removal action will taken until the paid period for the listing or advertisement has expired. Simply logging in and confirming your listing or advertisement information when requested to do so will ensure your listings are always live and up to date.

By placing an listing or advertisement with us you are granting us a licence, with a right to sub-license, to reproduce that listing or advertisement (including in a modified form) as part of or in association with the Mad About Birkenhead service on any web site or on any other media controlled by us or by any third party with whom we have, or enter into, an agreement for the provision of listings and advertisements.

Your credit card payment
You shall pay for the listing or advertisement in accordance with the rates displayed on the site. Our payment provider operates with secure keys to take your credit card details. Refunds will be given at the discretion of the Mad About Birkenhead management.

Your listing or advertisement
Where relevant, each individual listing or advertisement must be for only one product, item or service. Your listing or advertisement copy must be legal, decent, honest and truthful and comply with the British Code of Advertising Standards Authority guidelines and must be accurate and not infringe the rights of any third party. We may amend the listing or advertisement to ensure compliance with those requirements. Having in mind the nature of the service, we are not able to verify these issues with regard to any statements made by you in your listing or advertisement copy and accordingly you shall indemnify us and hold us harmless from all claims, costs and expenses (including legal expenses) resulting from your breach of this paragraph.

'One Advertiser' Banner Advertising Package Terms

Definitions:
"site" refers to all webpages that fall under the currently selected local town or region.
"banner" refers to a graphical advertisment.

By purchasing our 'One Advertiser' banner advertisment package you agree that:

1. Your banner advertising and associated service or product is considered family friendly, we will not for example accept advertising for adult, weapons, drugs or anything illegal. We reserve the right to define what advertising is acceptable on the site.

2. Your 'One Advertiser' banner advertisements are shown for your selected local region only. MadAbout.co.uk covers over 200 towns and cities across the UK, your advertisement will be shown for all webpages that fall under your selected town or city only.

3. You understand that our 'One Advertiser' package gives you sole exclusivity for the duration of your advertisment to the graphical banner advertisment spaces defined on this page for your selected town or region only. You agree that text based advertisments from other advertisers may be shown on your selected town or city site, and that listings submitted as part of our service as a local directory may include, and display, logo's and images as part of the listing.

4. We will provide you with one graphical banner free of charge if you do not have your own banner available. Additional versions or variations of the banner will be chargable except for where we are responsible for spelling errors.

5. You will pay for 12 months of advertising in advance at the rate displayed on this page. Your 12 months will begin at the time your advertisments are placed on the website, not at the time you make your payment. It can take 24-48 hours for your advertising to go live on the site.

Your personal data
By placing this order, you are requesting that your listing or advertisement appears on our web site and in other media in accordance with these terms. This means that the advert, including your telephone number and possibly other details can be viewed by anyone with Internet access throughout the world. You consent to the publication of the data in this way.

Changes, cancellations and interruptions
You have the right to cancel the listing or advertisement for any reason at any time. If we receive the cancellation before we accept the listing or advertisement, no payment will be taken. If we receive the cancellation after we accept the listing or advertisement you will not be entitled to any refund but will try to remove your listing or advertisement from the Mad About Birkenhead web site promptly. It is technically impossible to provide a web site free from interruptions and (except to the extent that interruptions are caused by our negligence) we do not guarantee that your listing or advertisement will be provided continuously or free of faults or errors. In addition, we will need to carry out maintenance of the web site from time to time and in doing so we shall attempt to keep the disruption to your listing or advertisement to a minimum.

Our liability
Where we have accepted an listing or advertisement but it does not appear on the web site at all you shall be entitled to a refund of the listing or advertisement price unless the omission is caused by unforeseen circumstances beyond our reasonable control or because of your breach of contract. Our liability to you for breach of contract or negligence shall not exceed an amount equal to the price you paid for any listing or advertisement or series of listings or advertisements placed by you on the site. In no event shall we be liable for any special, indirect, consequential or purely economic loss whatsoever or any loss of profit regardless of whether such losses are foreseeable and whether or not caused by our negligence arising out of or in connection with the use of the site. Nothing contained in these terms and conditions shall have effect so as to limit our liability for loss or damage arising out of personal injury or death or acts of fraud.

English law
These terms and the contract of which they form a part shall be governed by English law and shall be subject to the non-exclusive jurisdiction of the English courts. In the event of any inconsistency between these terms and the general Terms & Conditions, these terms shall prevail in respect of the purchase of adverts.
